Shing User Agreement

1. Acceptance of Terms

By downloading, installing, or using the Shing application ("App"), you agree to be bound by this User Agreement ("Agreement") and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this App.

Shing is designed to operate without requiring user accounts or login credentials. All data generated by your use of the App remains stored locally on your device, and no account creation is necessary to access core functionality.

2. App Purpose & Core Functionality

Shing is a personal gift and memory tracking tool that allows you to:

• Log gifts given and received, including recipient details, occasion, and reaction notes
• Track birthdays, anniversaries, and other important dates on a built-in calendar
• Receive gentle reminders for upcoming important events
• Export local data backups for safekeeping
• Maintain a private, personal history of thoughtful gestures and connections

All functionality is provided for personal, non-commercial use only.

3. User Responsibilities

As a user of Shing, you agree to the following:

• You will only use the App for lawful, personal purposes and will not use it to harass, threaten, or violate the rights of others
• You are solely responsible for the accuracy and completeness of the data you input into the App
• You will take reasonable steps to secure your device and protect the local data stored within Shing
• You will not attempt to reverse engineer, decompile, or modify the App’s source code or underlying technology
• You will not use the App to transmit or store any illegal, harmful, or offensive content

4. Data & Privacy

You may export a backup of your data at any time for personal safekeeping. Shing is not responsible for data loss resulting from device damage, deletion, or user error. We recommend regularly exporting backups to protect your information.

5. Intellectual Property Rights

The App, including all text, graphics, logos, icons, images, and software, is the exclusive property of Shing and is protected by United States copyright, trademark, and other intellectual property laws. You may not copy, distribute, modify, or create derivative works from any part of the App without explicit written permission from Shing.

6. Disclaimers & Limitation of Liability

The App is provided on an "as-is" and "as-available" basis. Shing makes no warranties, express or implied, regarding the App’s accuracy, reliability, or suitability for your purposes. To the fullest extent permitted by applicable law:

• Shing shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from your use of the App
• Shing shall not be liable for data loss, device malfunctions, or interruptions in service
• Shing does not guarantee uninterrupted, error-free operation of the App

7. Modifications to Agreement

Shing reserves the right to modify or update this Agreement at any time. We will notify users of material changes through in-app notifications or updates to this document. Your continued use of the App after such changes constitutes your acceptance of the revised terms.

8. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the United States of America, without regard to its conflict of law principles. Any disputes arising from this Agreement shall be resolved in the state or federal courts located within the United States.
